Terms of Service

Terms of Service

Effective Date: June 3, 2026
Business Name: Humby LLC
Website: https://humby.app

These Terms of Service (“Terms”) govern your use of Humby LLC’s website, booking flow, communications, and roadside battery jump-start services. By using our website, requesting service, submitting a booking, communicating with us, or receiving service, you agree to these Terms.

1. Our Service

Humby provides on-demand roadside battery jump-start services and related coordination, dispatch, customer support, payment, and follow-up communications.

Humby may provide services through employees, contractors, independent service providers, third-party roadside providers, tow partners, or other vendors.

2. Service Is Not Emergency Response

Humby is not 911, law enforcement, fire rescue, EMS, highway patrol, or an emergency response service.

If you are in immediate danger, involved in a crash, on an active highway shoulder, blocking traffic, experiencing a medical emergency, smelling fuel, seeing smoke, or facing any unsafe condition, call 911 or the appropriate emergency authority first.

We may decline, cancel, or redirect service if the location or situation appears unsafe.

3. Eligibility

You must be at least 18 years old to use Humby’s services. By requesting service, you confirm that you are legally able to agree to these Terms and authorize the requested service.

4. Booking and Service Requests

When you request service, you agree to provide accurate information, including:

  • Your name
  • Phone number
  • Vehicle location
  • Vehicle details
  • Safety conditions
  • Payment information
  • Any other information needed to dispatch service

You are responsible for making sure the vehicle location is accurate, accessible, and safe for the provider to reach.

5. Pricing, Authorization, and Payment

Humby may show an estimated or final price before dispatch. By confirming service, you authorize Humby or its payment processor to place an authorization hold and charge your payment method for approved services, fees, taxes, cancellation fees, no-show fees, or other disclosed charges.

The final charge may depend on your location, service area, provider availability, time of day, distance, safety conditions, service performed, cancellation timing, or other factors shown before confirmation.

We will not charge additional third-party tow or repair costs without your approval.

6. Authorization Holds

Humby may authorize a payment amount before dispatch to confirm that funds are available. An authorization hold is not always an immediate charge. If the final amount is lower, the unused portion may be released by your card issuer or payment provider according to their timeline.

7. Cancellations and No-Shows

You may cancel a service request before dispatch without charge unless otherwise stated during booking.

If you cancel after a provider has been dispatched, fail to appear, provide an inaccurate location, cannot be reached, or prevent the provider from completing the service, Humby may charge a cancellation, dispatch, or no-show fee shown during booking.

8. Jump-Start Limitations

A jump start may not fix every no-start condition. Your vehicle may fail to start because of a dead or damaged battery, alternator issue, starter issue, fuel issue, electrical problem, security lockout, key issue, mechanical failure, collision damage, or another condition outside the scope of a jump start.

Humby does not guarantee that your vehicle will start.

If a proper jump-start attempt does not resolve the issue, we may help connect you with a tow partner or other service provider. Any additional service requires your approval.

9. Safety Requirements

You agree to:

  • Stay in a safe location
  • Follow reasonable safety instructions
  • Tell us if the vehicle is on a shoulder, roadway, unsafe area, or restricted property
  • Disclose smoke, fire, crash damage, fuel smell, fluid leaks, or other hazards
  • Avoid interfering with the service provider’s work
  • Keep children, pets, and bystanders away from the service area

Humby or the service provider may refuse or stop service if conditions are unsafe.

10. Third-Party Providers

Humby may use independent contractors, roadside providers, tow companies, messaging providers, payment processors, or other third parties to provide or support services.

Third-party tow, repair, or roadside services may be subject to separate pricing, terms, availability, and liability limitations.

11. Text Messaging and Calls

By providing your phone number and opting in, you agree to receive text messages and calls from Humby related to your service request, dispatch, ETA, provider updates, payment, receipts, support, and service follow-up.

Message frequency varies. For a service request, you may receive multiple messages before, during, and after service. Message and data rates may apply.

Reply STOP to cancel text messages. Reply HELP for help.

Consent to receive marketing texts is not required to purchase services. Service-related texts may be necessary to provide dispatch, ETA, support, payment, and safety updates.

12. Marketing Messages

Humby will only send marketing or promotional text messages if you separately opt in to receive them.

If you opt in to marketing messages, message frequency may vary. Message and data rates may apply. Reply STOP to cancel. Reply HELP for help.

13. User Conduct

You agree not to:

  • Submit false, misleading, or fraudulent service requests
  • Abuse, threaten, harass, or endanger service providers or staff
  • Interfere with service delivery
  • Use the service for unlawful purposes
  • Attempt to avoid payment
  • Damage equipment or property
  • Misuse Humby’s website, forms, communications, or systems

14. Reviews and Feedback

You may choose to provide reviews, ratings, comments, photos, or feedback. By submitting feedback, you allow Humby to use it to improve services, respond to support issues, and, where permitted, display or reference it in marketing or business materials.

Do not submit private, unlawful, false, abusive, or third-party confidential information.

15. Service Availability

Humby may limit service areas, hours, availability, providers, vehicle types, roads, locations, or service conditions at any time.

We may decline or cancel a request if:

  • No provider is available
  • ETA is too long
  • The location is outside our service area
  • The vehicle is in an unsafe location
  • The requested service is outside our scope
  • Payment authorization fails
  • The request appears fraudulent, abusive, or unsafe

16. No Professional Repair Advice

Humby provides battery jump-start service and related coordination. We do not provide full mechanical inspection, repair, diagnosis, warranty service, or roadside repair unless specifically stated.

Any guidance we provide is limited to the service interaction and should not replace professional mechanical inspection or repair.

17. Limitation of Liability

To the fullest extent allowed by law, Humby and its owners, employees, contractors, providers, vendors, and affiliates are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages.

Humby’s total liability for any claim related to a service request is limited to the amount you paid Humby for that service request, unless applicable law requires otherwise.

Some states do not allow certain limitations, so some limitations may not apply to you.

18. Disclaimer of Warranties

Services are provided “as is” and “as available.” Humby does not guarantee uninterrupted availability, specific arrival times, successful jump start, vehicle operation, provider availability, or compatibility with every vehicle or situation.

19. Indemnification

You agree to defend, indemnify, and hold harmless Humby and its owners, employees, contractors, providers, vendors, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the services, violation of these Terms, unsafe conduct, inaccurate information, or violation of law.

20. Privacy

Your use of Humby’s services is also governed by our Privacy Policy: https://humby.app/about/privacy-policy.

21. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on https://humby.app with a new effective date. Continued use of our website or services after changes means you accept the updated Terms.

22. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
